Property Damage & Security Deposit

Guests are expected to treat the property, its furnishings, fixtures, and equipment with reasonable care. Any damage caused during your stay — whether accidental, negligent, or deliberate — is your financial responsibility.

Damage will be assessed at the end of your stay. The cost of repair, replacement, deep cleaning, or any consequential loss will be invoiced directly to the guest who made the booking. This includes but is not limited to: broken furniture, stained linen, damaged pool equipment, scratched surfaces, and any item requiring specialist cleaning or replacement.

A security deposit may be requested prior to check-in. Where a deposit is held, it will be returned in full within a reasonable period following check-out provided no damage has been identified. Where the cost of damage exceeds the deposit held, the guest remains liable for the difference.

Noise, Conduct & Hvar's Regulations

Hvar municipality enforces strict noise regulations, particularly during evening and night hours. Quiet hours apply between 23:00 and 08:00. This is not a guideline — it is enforced by local authorities and violations carry on-the-spot fines issued directly to occupants.

Guests are responsible for ensuring all members of their party observe these rules. This includes noise on terraces, balconies, the pool area, and in the garden. Music, amplified sound, and outdoor gatherings must be kept at a level that does not disturb neighbouring residents.

The host reserves the right to request that a stay be terminated without refund in cases of serious or repeated noise violations, antisocial behaviour, or conduct that threatens the safety, comfort, or wellbeing of neighbours or the property.

Guest Registration — A Legal Requirement

Under Croatian law, all persons staying overnight on the premises must be formally registered with the authorities. This is not a house rule — it is a legal obligation under the Tourism Act of the Republic of Croatia.

The booking confirmation covers only those guests whose details have been provided and registered at check-in. Unregistered guests are strictly prohibited from staying overnight, regardless of how briefly. Violations expose both the guest and the host to significant legal penalties, including fines and potential cancellation of the property's operating licence.

If additional guests join the party after check-in, they must be declared immediately so that registration can be completed. Day visitors who do not stay overnight are not subject to this requirement but must not exceed the maximum occupancy of the property.

Maximum occupancy: 16 persons. This limit must not be exceeded at any time, day or night. Exceeding it constitutes a breach of these terms and Croatian tourism law.

Pool, Terrace & Common Area Safety

Use of the private pool, terraces, and garden areas is entirely at guests' own risk. No lifeguard is present. Children must be supervised by a responsible adult at all times in and around the pool.

Guests are asked to observe the following at all times:

  • No glass in or immediately around the pool area
  • No diving or jumping from terraces or balconies
  • Children under 12 must wear appropriate floatation aids in the pool unless supervised by an adult within arm's reach
  • Pool chemicals and equipment are not to be tampered with
  • Furniture is not to be moved from terraces to the pool area without permission

The host accepts no liability for injury, illness, or accident arising from the use of the pool or outdoor areas, except where caused by a proven failure in the host's duty of care.

Check-in, Check-out & Access

Check-in is from 16:00. Check-out is by 10:00. These times exist to allow the property to be properly prepared between stays. Early check-in or late check-out may be arranged directly with Frane subject to availability, but cannot be guaranteed and may be subject to an additional fee.

Guests are required to present valid identification for all registered occupants at check-in. Access to the property constitutes acceptance of these terms in full.

The host or authorised staff may access the property during a stay for the purposes of housekeeping, maintenance, or emergency. Reasonable notice will be given except in genuine emergencies.

Smoking, Pets & Prohibited Activities

Smoking is permitted on the outdoor terraces and balconies only. Smoking is strictly prohibited inside the villa. Any evidence of indoor smoking will result in a cleaning charge of no less than €200, deducted from the security deposit or invoiced separately.

Pets are not permitted without explicit prior written consent from the host. Unauthorised animals on the premises constitute a breach of these terms and may result in additional cleaning charges.

The following are prohibited at all times:

  • Parties or events beyond the registered guest group without prior agreement
  • Commercial photography or filming without written consent
  • Any illegal activity on or in connection with the premises
  • Tampering with any security camera, lock, or access system
  • Subletting or granting access to any third party not registered as a guest

Cancellation & Refund Policy

The cancellation policy applied to all direct bookings with Villa Katarina is the Strict policy, consistent with the policy applied to the listing on Airbnb. This is the same policy regardless of how or where you book.

This policy mirrors the Strict cancellation policy on our Airbnb listing. Bookings made through Airbnb are subject to Airbnb's own processing and refund procedures.

No refunds will be issued for early departures, unused nights, or changes in personal circumstances after the cancellation window has passed. In exceptional circumstances — serious illness with medical documentation, force majeure events — requests for discretionary consideration may be directed to Frane directly and will be assessed on a case-by-case basis.

Limitation of Liability

Villa Katarina and its owner, Frane Gjeldum, take reasonable steps to ensure the property is safe, well-maintained, and accurately represented. However, to the fullest extent permitted by applicable law:

  • We accept no liability for personal injury or illness sustained during a stay, except where directly caused by a proven failure in our duty of care
  • We accept no liability for loss, theft, or damage to personal belongings on the premises
  • We accept no liability for disruption caused by factors outside our control, including but not limited to: adverse weather, utility outages, construction in the vicinity, local events, or disruptions to transport
  • We accept no liability for the services, conduct, or quality of any third-party provider recommended by the host

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded under the laws of the Republic of Croatia.

Disputes & Governing Law

Any dispute arising from a stay at Villa Katarina should in the first instance be raised directly with Frane Gjeldum, Private Renter, either in person, by phone, or in writing via the contact details below. The majority of concerns can and will be resolved quickly and directly.

Where a booking was made through Airbnb, disputes relating to payments and refunds processed through that platform are subject to Airbnb's own Resolution Centre procedures.

These terms are governed by the laws of the Republic of Croatia. Any dispute that cannot be resolved by direct agreement shall be subject to the jurisdiction of the Croatian courts. Your statutory consumer rights under Croatian and applicable EU law are not affected by anything in these terms.
